KVKK Information Notice

This notice is provided by SOCIFLY SOFTWARE LTD., as data controller, under Article 10 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”) to visitors and members of www.wapifly.com, team members invited by members and people who use the trial form. For data of the people our customers communicate with, which we process on our customers’ behalf, the relevant customer is the data controller; see section 7 of the Privacy Policy.

1. Data controller

2. Personal data processed

∘ Identity: name, surname; optionally date of birth and gender.
∘ Contact: e-mail address, phone / WhatsApp number, country, city.
∘ Customer transactions and finance: purchased services, balance, bank transfer records, billing details (company name, national ID or tax number, tax office, address).
∘ Transaction security: IP address, browser information, login and activity logs, password hash, two-factor authentication and API key data.
∘ Team members: the name, surname, e-mail address, password hash, role, last sign-in date and IP address of team members invited by our members for the inbox.
∘ Trial form: the phone number entered in the “Try Now” form and the trial message sent to it.
∘ Requests / complaints: contact form and support correspondence.

3. Purposes and legal grounds

∘ Concluding and performing the membership and service contract, providing and renewing the service, sending service notifications — KVKK Art. 5/2-c (conclusion or performance of a contract).
∘ Invoicing, accounting, responding to requests from authorities — KVKK Art. 5/2-ç (legal obligation).
∘ Information security, preventing abuse, answering support requests, sending the trial message — KVKK Art. 5/2-f (legitimate interest) and Art. 5/2-c for the trial form.
∘ Establishing, exercising and protecting rights — KVKK Art. 5/2-e.

4. Method of collection

Data is collected electronically and by automated means through forms on our website and panel, API requests, and e-mail and WhatsApp correspondence.

5. Transfers

Limited to the purposes above, your personal data may be transferred to our hosting (server) provider, to Cloudflare, Inc. (USA) for content delivery and security, to Google LLC (Google Drive) for backups, to Brevo (France) for e-mail delivery, to the instant messaging service we use for system alerts, to Meta Platforms for WhatsApp delivery, and to competent public authorities upon request. As our Company is established in the Turkish Republic of Northern Cyprus and our technical infrastructure providers are located abroad (European Union and USA), your personal data is processed and stored outside Turkey. Giving explicit consent to international transfer during registration or in the control panel is optional; not giving consent does not prevent you from using the service.

6. Your rights

Under Article 11 of the KVKK you have the right to learn whether your personal data is processed, request information if it has been processed, learn the purpose of processing and whether it is used accordingly, know the third parties in Turkey or abroad to which it is transferred, request correction of incomplete or inaccurate data, request deletion or destruction under Article 7 and notification of these actions to third parties, object to a result against you arising exclusively from automated analysis, and claim compensation for damage caused by unlawful processing.
